The Draft Presidential Decree on the Right of the Publisher Enters the Ministry of Justice and Human Rights, Kominfo: There May Be Changes.

TEMPO Co, Jakarta – Director General of Information and Public Communications of the Ministry of Communications and Information (Cominfo) Usman Kansong said that the draft Perpres on Publisher Rights has been submitted to the Ministry of Law and Human Rights (Kemenkumham), in early May 2023. The regulations that will control the cooperation of publishing companies with digital systems will be harmonized soon.

“There are changes (arguments in the draft) based on the opinions of the meetings and discussions. And in harmonizing there is still the possibility of more changes,” Kansong said when contacted. Tempo by phone on Thursday, 25 May 2023.

Kansong said the process of drafting this code is dynamic. But what is clear, he said, Kominfo has invited the players of the digital ecosystem, such as Googleto give an opinion.

Kansong did not specify any further changes to the argument in the draft regulations. But broadly, Kansong has said that Perpres on Publisher Rights will regulate the media business system. Cooperation between digital platforms and media is carried out on a business-to-business or B2B basis.

For a B2B system, the negotiation process between parties is about advertising results, compensation or payment. This procedure will also be further regulated in derivative laws made by implementing regulations. The government will also create an agency or institution that will manage the cooperation process.
